Performance Marketing & KPI-Based Engagements

Terms & Conditions

1. Service Scope

Jewell Projects offers performance-driven marketing services designed to optimise customer acquisition, conversion, and ROI through data-led strategies. These include:

  • Lead Generation Campaigns & Funnel Optimisation
  • Pay-for-Performance Campaign Models (e.g., Cost-per-Lead or Cost-per-Acquisition structures)
  • ROI Tracking & Conversion Rate Optimisation (CRO)
  • KPI-Based Incentive Programs
  • Service Level Agreement (SLA) Metrics for campaign performance, response time, and reporting

Engagements may be structured as fixed+incentive, retainer+bonus, or full performance-based campaigns.

2. Client Responsibilities

The client agrees to:

  • Provide transparent access to ad platforms, analytics dashboards, CRM systems, and lead tracking environments.
  • Maintain data accuracy, attribution logic, and visibility on internal sales outcomes.
  • Collaborate to set realistic, measurable KPIs in writing prior to campaign commencement.
  • Commit to timely review of campaign proposals, creative approvals, and lead feedback to ensure optimised performance.

Failure to maintain CRM hygiene, conversion tracking, or attribution clarity may impact KPI calculation and billing.

3. Deliverables & Timelines

Deliverables may include:

  • Lead generation campaigns across digital platforms (search, social, native)
  • Funnel mapping, A/B tests, landing page builds
  • CRM integration & attribution setup (e.g., UTM, conversion pixels)
  • Weekly or monthly reporting against performance KPIs
  • Recommendations and iteration roadmaps

Timelines for full-funnel implementation vary but typically range from 2–6 weeks pre-launch. Post-launch optimisation is continuous across the campaign lifecycle.

4. IP & Confidentiality

  • Campaign strategies, ads, and creative produced by Jewell Projects are licensed to the client upon full payment.
  • Data, CRM entries, and lead lists generated are the client’s property.
  • Jewell Projects may use anonymised performance data in benchmarking reports or case studies unless expressly prohibited.

All performance data, user behaviour logs, and campaign tracking files are confidential and treated accordingly.

5. Payment Terms

Payment models may include:

  • Hybrid retainers (base + bonus on hitting KPI)
  • Flat-rate performance billing (e.g., per lead or conversion)
  • Tiered incentives based on milestone results (e.g., CPL brackets, conversion rate targets)

Terms are outlined in the campaign agreement and payable:

  • Monthly in arrears (for performance-based billing)
  • Monthly in advance (for retainer or setup fees)
  • Bonuses within 7 days of verified results

Media spend is always billed separately and directly to the client’s platform.

6. Termination Clauses

  • A 30-day written notice is required to terminate any performance-based engagement.
  • All verified results delivered prior to termination remain billable.
  • Access and data will be handed back post-termination; final reports will be issued upon closure.

Termination for breach of KPIs must follow a formal review process agreed upon in the SLA.

7. Disclaimers

  • Jewell Projects will act in good faith to meet campaign KPIs, but cannot guarantee exact outcomes due to market fluctuations, platform algorithm changes, and audience behaviour.
  • If the client delays feedback, alters conversion workflows, or changes platform access, campaign performance may be affected and KPI-related incentives may still be payable.
  • Bonus payments are subject to agreed attribution models and require client-side cooperation.

8. NSW / Australian Law Reference

These Terms & Conditions are governed by the laws of New South Wales, Australia. All performance marketing services are subject to the Australian Consumer Law, Privacy Act 1988 (Cth), and applicable advertising regulations. Disputes shall be resolved under the exclusive jurisdiction of the NSW courts.
